Terms of use

1. Who we are

TestConnect (testconnect.co.uk and the TestConnect apps) is operated by Wilgenry Software Ltd, a company registered in England and Wales [company number, registered office] ("we", "us").

2. What TestConnect is

TestConnect is a platform where organisations that need building compliance tests ("job owners") and qualified testers can find each other, arrange tests, record results and share certificates. It also gives testers tools to run their business. We are not a party to the contract between a job owner and a tester, and we do not carry out tests ourselves. TestConnect is not a testing or competent person scheme: we don't audit, certify or lodge on anyone's behalf.

3. Accounts

• While we grow, sign-up is by invitation: you need an invite code from us to create a new organisation.
• You must give accurate information and keep your sign-in details secure. Turn on two-factor authentication where it is offered.
• Organisation administrators are responsible for who they invite and the roles they give them.
• We may suspend accounts that break these terms, put others at risk or provide false compliance information.

4. Testers

• You must hold, and keep current, the scheme memberships, insurance, qualifications and calibrated equipment that the jobs you take require. Anything you add to your profile, such as a scheme membership number, must be accurate. We don't certify these details, even if you ask us to look them over: your scheme remains responsible for your membership and competence.
• You must record results truthfully. Results cannot be deleted. If you correct a result, the original is kept alongside the correction, with your reason.
• You are responsible for lodging certificates with your scheme where this is required.

5. Job owners

• You must describe jobs accurately, including access, site readiness and any hazards. You must pay testers in line with the agreed terms.
• Cancellations and late changes are subject to the cancellation terms shown on the job.

6. Fees and subscriptions

Current plans and prices are shown in the app and on our pricing page. Paid subscriptions renew monthly until you cancel them. New tester businesses get a free trial of Pro for the trial length shown when you sign up (60 days by default). A trial period only turns into a paid plan if you choose one. We don't take a commission on jobs or payments. [Any platform fees are shown before a job is posted or accepted.]

Prices and plans. We may change our prices, start charging for features that are free today, or change what each plan includes. We'll tell you by email and in the app at least 30 days before any change that costs you more or removes something you use. The change applies from your next billing period after that notice ends, and you can cancel or move to the Free plan at any time before then without charge. Offers we've already given you, such as a free trial, are honoured for their stated period. Your data stays yours whatever happens, and you can download all of it at any time.

7. Ratings and disputes

Ratings must be fair and based on the service received. We provide a dispute process to help users resolve problems with each other, but we do not act as an arbitrator. Our feedback policy and code of conduct form part of these terms.

8. Liability

[Limitation of liability wording to be provided by a solicitor.] Nothing in these terms limits any liability that cannot be limited by law.

9. Changes

We may update these terms. We will tell you about important changes in the app or by email before they take effect.

10. Law

These terms are governed by the law of England and Wales.
